If you are constructing a vehicle jointly with another manufacturer − for example, to modify or complete the vehicle (phased construction) − it is important that you communicate closely with each other. During your phase of the construction process, you must comply with the regulations and procedures in the Framework Directives. Not all vehicles are eligible for phased construction. The requirements to be satisfied by the vehicle, by the technical units (components) and by you as a manufacturer are listed below.
Requirements for vehicles
Only vehicles that come under Directive 2007/46/EC (see the vehicle categories and the Framework Directives) are eligible for phased production. For EC type-approval of the entire vehicle, all the manufacturers concerned must comply with the regulations in this directive. One of these regulations relates to agreement about the exchange of data.
Because this directive also covers the national type-approval of small production series, phased approval is also possible for this type.
Requirements for the technical units
Requirements will also be defined for the individual technical units that you add to the vehicle during the phased construction. An individual technical unit is a device or system to which statutory guidelines apply, which is intended as part of a vehicle, and which can be subjected to a separate type-approval. However, this only applies to (one or more) specified vehicle types and only if the legislation explicitly allows it. In that case, the vehicle in which the technical unit will be fitted must also be specified.
Requirements for the manufacturer
In accordance with the appendices of the Framework Directives, vehicle manufacturers can only apply for type-approvals for individual technical units, systems and/or complete vehicles. An individual technical unit is a device or system to which statutory guidelines apply, which is intended as part of a vehicle, and which can be subjected to a separate type-approval. However, this only applies to (one or more) specified vehicle types and only if the legislation explicitly allows it. In that case, the vehicle in which the technical unit will be fitted must also be specified.
As a manufacturer, you are the person or legal entity that is answerable to the body issuing the type-approval for all aspects of the type-approval process and for upholding the conformity of the production.
You do not have to be directly involved in all the construction phases of the vehicle, the system, the component or the individual technical unit to which the approval process relates. You are responsible for approval of your particular phase in a multi-phase construction.
For EC type-approvals, manufacturers outside the EU must appoint a representative in the EU. This representative company can be held responsible for all aspects of the type-approval and recall process. Because the parties concerned must cooperate closely, the RDW has drawn up a model of the certificate for representatives.
For the phased national type-approval of small production series, the manufacturer does not have to comply with as many regulations: This depends on the degree of the modifications made to the basic vehicle.
