Vehicle safety
The Commodities Act specifies that producers and distributors are obliged to report recurrent defects in vehicles and/or components of vehicles. If there is a risk of physical injury due to those defects, a recall process must be organized.
Obligations for producer / distributor
If you are a producer or distributor of a product where defects have been found, you have certain obligations.
These obligations mean that you:
- Inform the competent authorities,
- Inform the consumer,
- Recall the product.
These obligations are described in the Commodities Act. The basis for these obligations is laid down in Directive 2001/95 / EC.
In the Netherlands, the RDW is responsible for supervising this recall process.
